General Terms and Conditions HelpMeWithIT.nl 2024

Article 1 - Definitions

  1. Platform: The online service provided by [Platform Name], hereinafter referred to as "the Platform."

  2. Buyer: Any individual or entity purchasing services through the Platform.

  3. Seller: Any individual or entity offering services through the Platform.

  4. Projects: Assignments posted by a Buyer for Sellers to bid on.

  5. Commission: The percentage or fixed amount deducted by the Platform from the Seller’s sale price.


Article 2 - Services

  1. The Platform provides an online marketplace for Buyers and Sellers to exchange services.

  2. The Platform does not guarantee the quality, suitability, or success of services or projects.

  3. The Platform is transparent about fees and terms and informs users before they enter into a membership agreement.


Article 3 - Commissions and Payments

  1. The Platform charges a commission on each transaction based on the Seller’s level.

  2. Commissions are automatically deducted from the sale price before payment to the Seller.

  3. The Platform clearly informs the Seller about applicable commissions.


Article 4 - User Responsibilities

  1. Users must not post unlawful, inaccurate, or misleading information.

  2. Behavior contrary to the law, such as threats, defamation, or racism, is prohibited.

  3. Users are responsible for the information and offers they share via the Platform.


Article 5 - Availability

  1. The Platform aims for continuous availability but cannot guarantee it.

  2. Maintenance will be announced in advance when possible.


Article 6 - Privacy

  1. The Platform processes personal data in compliance with applicable laws and regulations.

  2. The Platform reserves the right to monitor data in cases of suspected misuse.


Article 7 - Liability

  1. The Platform is not liable for damages arising from interactions between Buyers and Sellers.

  2. Users indemnify the Platform from claims arising from their use of the Platform.


Article 8 - Termination

  1. General Termination
    Users may terminate their membership at any time via the Platform. Deactivation or deletion requests will be processed within two weeks.

    Pending Assignments at Termination
    a. If there are pending assignments at the time of termination, the membership will only be terminated after:

    1. All pending assignments have been fully completed and accepted by the involved parties;
    2. Any payments related to these assignments have been finalized; and
    3. Any disputes, if applicable, have been resolved.

    b. The Platform reserves the right to verify the status of pending assignments before processing a termination request to ensure that users fulfill their obligations.

    Obligations During Termination
    During the processing of the termination, the user remains responsible for meeting all obligations arising from previously undertaken assignments. This includes, but is not limited to:

    1. Completing assignments in accordance with the agreed terms;
    2. Fulfilling payment obligations, if applicable.

    Specific Conditions for Sellers
    If a seller requests termination while payments or assignments are still in progress:

    1. The termination will be postponed until all assignments are completed;
    2. The seller must ensure that the assignment status is correctly finalized (e.g., "completed" or "canceled").

Article 9 - Complaints Procedure

  1. Complaints about services or users will be addressed within five working days.
